The issuance of the Regulation aims to concretize the Government's provisions on the management of foreign aid and to enhance the effectiveness and efficiency of state management, while ensuring that the receipt, management, and use of aid are carried out for the right purposes in an open, transparent, and effective manner, serving the local socio-economic development goals.

The Regulation specifies the scope of regulation, the subjects of application, and the principles for managing and using aid; the dossiers, order, and procedures for preparing, appraising, and approving documents and aid amounts; the management and organization of the implementation of aid programs, projects, and non-project aid; and the management of aid finances and assets and the information and reporting regime.

Under the Regulation, the subjects of application are agencies, organizations, and individuals participating in or related to the management and use of non-ODA non-refundable aid in the province. Aid providers include international organizations, foreign non-governmental organizations, diplomatic missions, foreign enterprises, organizations, and individuals, and overseas Vietnamese. Aid recipients are state agencies, public non-business units, political organizations, socio-political organizations, associations, social funds, charitable funds, and organizations legally established under the laws of Vietnam.

To enhance state management responsibility, under the Regulation, the Provincial People's Committee assigned the Department of Finance as the focal agency to receive dossiers for aid amounts under the approval authority of the Chairman of the Provincial People's Committee, while taking the lead in appraisal and advising the competent authority for review and decision in accordance with regulations. The Provincial People's Committee required that the management and use of aid comply with the law and be consistent with the locality's socio-economic development goals and humanitarian and social welfare support activities; not serve profit or commercial purposes; and ensure efficiency and transparency during implementation.

The Decision takes effect as of June 25, 2026. At the same time, it repeals Decision No. 46/2022/QD-UBND dated December 9, 2022 of the Bac Kan Provincial People's Committee on issuing the Regulation on the management and use of non-refundable aid not classified as official development assistance in Bac Kan Province. The issuance of the new Regulation helps improve the legal basis and enhance the efficiency of the management and use of foreign aid, serving the province's socio-economic development goals in the new period.
