Some policies on investment support and encouragement in Thai Nguyen Province (24/11/2015)

In addition to investment incentives prescribed in the Law on Investment, Law on Enterprises, Law on Cooperatives, Law on Land, Law on Corporate
Income Tax, Law on Import and Export duties... and other related legal regulation, when locating projects in Thai Nguyen province, investors shall be
subject to the investment support and encouragement policies in the province as:
  I. Land rent reduction and exemption
  1. Land rents shall be exempted in the following cases:
  - Investment projects in the domains where investment is specially encouraged, which are executed in geographical areas facing exceptional socio-economic difficulties as Dinh Hoa and Vo Nhai districts.
  - Projects involving the use of land for construction of condominiums for industrial park workers under projects approved by competent authorities,
covering the house-selling prices or house-leasing prices which do not include land rent expenses; projects involving the use of land for construction of
students’dormitories with state budget money, for which the units assigned to manage such dormitories may only calculate charges enough to cover expenses for services, electricity and water supply, for management and other relevant expenses and must not calculate land rent expenses and depreciate
the houses; projects involving the use of land for construction of public facilities for business purposes (socialization) in the fields of education, health, physical
training, sport, science and technology.
  2. Land rents shall be exempted in the following cases:
  - Rents shall be exempted in the duration of construction under projects approved by competent authorities; in cases where a project is composed of
many construction items or involves independent construction stages, rents shall be exempted according to each item or each independent construction
stage; where it is impossible to separately calculate the rent for each construction item or independent construction stage, the construction duration
shall be that of the construction item with the largest capital proportion.
  - Rents shall be exempted as from the date the project is completed and put into operation, specifically as follows:
  + Three (3) years for projects in domains on the list of those eligible for investment promotion; at new production or business establishments of
economic organizations which are relocated under plans or due to environment pollution;
  + Seven (7) years for investment projects in geographical areas facing socioeconomic difficulties as Dong Hy, Dai Tu, Phu Luong, Phu Binh districts,
Pho Yen town and Vinh Son and Binh Son communes in Song Cong city;

  + Eleven (11) years for investment projects in geographical areas facing exceptional socioeconomic difficulties as Vo Nhai and Dinh Hoa districts;
projects in domains on the list of those eligible for special investment promotion; and projects in domains on the list of those eligible for investment promotion
which are implemented in geographical areas facing socio-economic difficulties as Dong Hy, Dai Tu, Phu Luong, Phu Binh districts, Pho Yen town and Vinh
Son and Binh Son communes in Song Cong city;
  + Fifteen (15) years for projects in domains on the list of those eligible for investment promotion which are implemented in geographical areas facing
exceptional socio-economic difficulties as Vo Nhai and Dinh Hoa districts; and projects in domains on the list of those eligible for special investment promotion
which are implemented in geographical areas facing socio-economic difficulties as Dong Hy, Dai Tu, Phu Luong, Phu Binh districts, Pho Yen town and Vinh
Son and Binh Son communes in Song Cong city;
  - Land rented for use as ground for production and/or business activities of cooperatives shall be entitled to 50% land rent reduction.
  3. Investors who are leased land by the State and have advanced money for land compensations, resettlement supports and fee of implementing the approved plan of site compensation and clearance shall have such compensation or support money subtracted from the
payable land rents.
  II. Land rent units, water surface rent units of each project
  1. For projects in which land rent is paid annually
  a) For projects renting land not through auction:
  The annual land rent unit = Percentage (%) x The land price for renting land.

  b) For the case in which land rent is paid in lump-sum for the whole lease
duration and not through auction: Land rent unit is the land price determined by
using land duration corresponding with lease duration.
  2. Land rent unit in case of auction of the rented-land use rights
  a) In case that the land rent amount is paid annually, the land rent unit shall be
winning bids of one year duration.
  b) In case that the land rent amount if paid in lump-sum for the whole lease duration, the land rent unit shall be winning bids of lease duration.
  3. Land rent unit in case of renting land for constructing underground work
  With the land is leased by the State for constructing underground work (not the underground part of above-ground structure) prescribed in the Law on land, land
rent unit is determined as follows:
  a) For the case in which land rent is paid annually: Land rent unit is 20% of the surface land rent unit in case that the land rent is paid annually with the same
purpose of utilization.
  b) For the case in which land rent is paid in lump-sum for the whole lease duration: Land rent unit is 20% of the surface land rent unit in case that the land rent
is paid in lump-sum for the whole lease duration with the same purpose of utilization and lease duration.
  c) The land for constructing underground work associated with the underground part of above-ground structure that the area of constructing underground work
beyond the area of surface land paid land rent, the land rent must pay for the extra area prescribed in Point a, Clause 3, of this Article.
  4. Land rent unit for land with water surface belong to the land group prescribed by Article 10 of the Law on Land
  a) For the area of land without water surface: Land rent unit in case that the land rent is paid annually, land rent unit in case that the land rent is paid in lump-
sum for the whole lease duration prescribed in Point a, Clause 1, of Section II above.
  b) For the area of land with water surface:
  For projects have the area of land with water surface in communes, towns of Vo Nhai and Dinh Hoa districts; mountainous communes in region III; projects
for agro-forestry production, aquaculture in the province; renting land with water surface for making ground of production or business activities under investment
projects on domains eligible for investment promotion and domains eligible for special investment promotion,the land rent unit for land with water surface is 50%
rent unit of the adjacent land with the same purpose of utilization.

  For case not within the scope of above regulations, the land rent unit for land with water surface is 70% rent unit of the adjacent land with the same purpose of utilization.
  III. Support vocational training
  1. With respect to projects included in the list of investment encouragement of Thai Nguyen province, when investors have demand of vocational training and
employ trained labors who have resident address in the province, those investors shall enjoy the support of vocational training fee as follows:
- Support 25% tuition with respect to projects employing 50-150 trained labors.
- Support 40% tuition with respect to projects employing 151-300 trained labors.
- Support 50% tuition with respect to projects employing over 300 trained labors.
  2. Agency responsible for receiving, considering and deciding the  support  of  vocational training fee: Thai Nguyen Department of Labor, War Invalids and Social Aff.
  IV. Support and consultation with respect to administrative procedures related to investment activities
  The Investment Consultation and Promotion Center of  Thai Nguyen is a unit directly under Thai Nguyen Department of Planning and Invesment, responsible for
providing invesment promotion services, cooperates with departments and other agencies of Thai Nguyen province to provide consultation to investors with respect
to administrative procedures related to investment activities in the province.  Investment consultation activities comprise: Providing information on land
utilization planning, construction planning, fi planning; list of projects calling for investment of the province; providing guidelines on administrative procedures at
request of investors in such fi as investment, land, construction, environment, tax, labor, investment incentives; Creating favorable conditions for investors to survey
and select location for project implementation...
